These Terms and Conditions govern the use of margaridaximenes.com (including the English version and UGC page) and enquiries and quote requests made through it.

1. Service provider

2. Scope

  1. The website presents services in digital operations, virtual assistance, guest and reservation management, channel optimisation, social media management, systems and CRM, as well as UGC and content creation services.
  2. Website information is general and informative and does not constitute a binding contractual offer.

3. Use of the website

  1. Users agree to use the website lawfully, without disrupting its operation, attempting to access restricted areas, or using forms to send illegal, false or abusive content.
  2. The Provider may restrict access to the website or forms in cases of abusive use.

4. Contact requests and quotes

  1. Forms and contacts by email or phone are used to assess needs and prepare a proposal. Submitting a request creates no obligation to contract for either party.
  2. Services are only provided after acceptance of a written proposal and signing of a service agreement, or written acceptance by email.

5. Pricing and modalities

  1. Prices indicated on the website are indicative. The current base rate is €20 per hour, subject to adjustment based on the type and complexity of each project.
  2. Final prices are defined in each proposal, on a monthly retainer, hourly or per-project basis, and are valid only for that proposal and within the stated timeframe.
  3. Where applicable, prices are subject to VAT at the applicable legal rate. The Provider is currently VAT-exempt under Article 53 of the Portuguese VAT Code, so prices do not include VAT.

6. Cancellation and refunds

  1. Cancellation, termination and refunds for contracted services are governed by the service agreement between the parties.
  2. Services are provided exclusively to professional clients (companies, sole traders or other entities), so consumer protection rules do not apply, without prejudice to mandatory legal provisions.

7. Content and intellectual property

  1. The design, texts, logo, MX brand and other website content are the property of the Provider or used with authorisation, and may not be copied, reproduced or distributed without written permission.
  2. Work examples in the portfolio are shown with client authorisation or in a way that does not reveal confidential information.

8. Links and third-party services

The website may contain links to third-party platforms (such as Airbnb, Booking.com, Notion, LinkedIn or social media). The Provider does not control those sites and is not responsible for their content, policies or failures.

9. Limitation of liability

  1. The Provider aims to keep website information up to date and accurate, but does not guarantee the absence of errors or permanent availability of the website.
  2. The Provider is not liable for damages resulting from decisions taken solely on the basis of website information, without prejudice to applicable law.

10. Data protection

The processing of personal data is governed by the Privacy Policy, which forms an integral part of these Terms.

12. Changes

The Provider may amend these Terms at any time. The version in force is the one published on the website, with the date of update indicated.

13. Governing law and jurisdiction

  1. These Terms are governed by Portuguese law.
  2. For disputes with professional clients, the parties elect the courts of Setúbal, without prejudice to applicable consumer dispute mechanisms.
